Terms of Service

1. Acceptance of these terms

By creating an account or using Banana Lab (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

You must be at least 16 years old to use the Service. You are responsible for keeping your password confidential and for any activity under your account. Provide accurate information when you register.

3. Acceptable use

You agree not to use the Service to:

  • generate content that is unlawful, infringes third-party rights, depicts sexualized minors, or that the underlying AI providers (Google or OpenAI) forbid by their usage policies;
  • attempt to circumvent rate limits, security measures, or access controls;
  • impersonate another person or misrepresent your affiliation;
  • scrape or bulk-download other users' content.

4. Your content

You retain ownership of the prompts, input images, and shared content you submit, to the extent rights are available to you under applicable law. By sharing a prompt and image to the community feed, you grant Banana Lab a worldwide, royalty-free, non-exclusive license to host, display, and distribute that content within the Service for as long as you keep it shared. You can unshare or delete at any time from your library.

5. AI-generated content

Images you generate are produced by third-party AI models. We do not guarantee that AI outputs are original, accurate, or free of third-party claims. Use of the underlying models is also subject to Google's and OpenAI's own terms, which apply concurrently. You are responsible for any downstream use of generated images.

6. Third-party services

The Service depends on Supabase (auth, database, storage), Vercel (hosting and AI gateway), Google, and OpenAI. Their terms apply to the parts of the Service they power. We are not responsible for those providers' outages or actions.

7. Termination

You can delete your account at any time from Profile → Delete my account. We may suspend or terminate your access if you violate these Terms, harm other users, or create excessive cost or risk. Where reasonable, we will give notice.

8. Disclaimers

The Service is provided "as is" and "as available". We make no warranty of merchantability, fitness for a particular purpose, or non-infringement to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Banana Lab is not liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our aggregate liability for direct damages is limited to the amount you have paid us in the 12 months preceding the claim, or USD 100, whichever is greater. Nothing in this section limits liability that cannot be limited under applicable consumer-protection law.

10. Governing law

These Terms are governed by the laws of [jurisdiction — please update], without regard to conflict-of-law principles. The courts of that jurisdiction have exclusive venue, subject to your mandatory consumer rights to bring claims in your country of residence.

11. Changes

We may update these Terms. Material changes will be flagged on this page. Continued use after a change constitutes acceptance.
